- AREA OFAPPLICABILITY
These General Terms and Conditions (hereinafter referred to as “GTC”) apply to the rental of rooms, apartments and/or seminar and banqueting facilities and to all other associated services and deliverables provided by Hotel Maistra 160, Plattner und Plattner AG (hereinafter referred to as “hotel,” “we,” “us,” or “our”) to customers. Customers are any natural and legal persons who rent rooms and/or seminar and banqueting facilities from the hotel. All services provided by the hotel are based on these GTC. They form an integral part of every contract between the hotel and a customer. Should the GTC contradict any contractual conditions of a customer, these GTC for hotel reservations shall take precedence.
1.1 Room and apartment reservation/contract conclusion
Following the reservation by the guest, the guest shall receive a written reservation confirmation from the hotel or the booking platform through which the booking was made. The contract between the parties is concluded only upon delivery of the written reservation confirmation to the guest. In the case of guests who arrive at the hotel without prior reservation or who extend their stay when they are at the hotel, the contract is concluded verbally.
1.2 Booking changes
Changes to the content of the contract are only binding once they have been confirmed in writing by the hotel or the relevant booking platform.
1.3 Arrival and departure
Rooms and apartments are only available from 15:00 on the day of arrival. On the day of departure, rooms must be vacated by 11:00, and apartments by 10:00. After this time, the hotel may charge 50% of the full accommodation price for late checkout from the room/apartment for its use in excess of the time stipulated in the contract, up until 18:00. After 18:00, a charge of 100% is payable.
1.4 Cancelation conditions and payment terms for “Best available rate”
The following cancelation conditions apply to the “Best available rate,” standard rate, best daily rate, and our packages:

1.5 Cancelation conditions and payment terms for “Non-refundable rate”
This rate is non-cancelable and non-refundable. The total price of the reservation is due at the time of booking and must be paid in full.
1.6 Cancelation conditions and payment terms – Christmas/New Year
The following cancelation and payment conditions apply to bookings over the Christmas/New Year holidays:
For bookings of five nights or more, a deposit of 50% of the total price is due by October 31 at the latest.

1.7 Group reservations (without Seminar or banquet services)
A reservations of 8 or more rooms is considered a group reservation in accordance with the GTC, and the following cancelation and payment conditions apply:

1.8 No-show, late arrival, and early departure
These cancelation conditions also apply to no-shows as well as late arrivals or early departures.
- EVENTS, SEMINARS AND BANQUETS
2.1 Conclusion of contract
The reservation agreement and any changes to the services provided by Hotel Maistra 160 shall only become binding for both parties once they have been confirmed or reconfirmed in writing by the hotel and the organizer.
The Hotel Maistra 160 reserves the right to allocate individual rooms (max. 10% of the contingent) to a different room category.
2.2 Room use/authorizations
The hotel reserves the right to make room changes, taking into account the size of the group. Any subletting or re-letting of rooms or areas by the customer requires the prior written consent of the hotel.
Unless the individual contract states otherwise, the organizer must obtain any necessary permits himself and at his own expense. Copyright compensation in connection with music performances must be registered and paid for by the organizer himself.
Costs incurred in connection with such authorizations and/or copyright compensation must be reimbursed to the hotel by the customer.
2.3 Participant numbers
The organizer must inform the hotel of the definitive number of participants at least 48 hours prior to the event in the case of banquets and at least 14 days prior to the event in the case of seminars. If the actual number of persons is subsequently lower, the number of participants stated by the organizer shall be used as the basis for invoicing; if the actual number of persons is higher, the hotel does not guarantee that all guests will be accommodated, and the actual costs incurred shall be invoiced.
The seating plan must be communicated to the hotel at least 3 days prior to the event.
The organizer shall communicate the exact program schedule (times for breaks, speeches, etc.) at least 48 hours in advance for banquets and at least 7 days in advance for seminars.
2.4 Payment conditions
The hotel reserves the right to demand an advance payment upon conclusion of the contract. As a rule, this must be paid up to 90 days prior to the start of the event and amounts to around 50% of the services offered. If the hotel does not apply this right, a payment period of 20 days net applies to the final invoice, which will be sent to the customer following the end of the event.
2.5 Cancelation conditions
From 8 to 12 reserved rooms:

2.6 Supplements
For organized events going on past midnight, we will be happy to organize the required extensions. We charge an additional 50% of the hourly rate of the respective employee for each hour or part thereof.
2.7 Exclusive use of the entire hotel
Part cancelation is not possible for exclusive use.

2.8 Fire regulations/safety regulations/decoration material
The organizer undertakes to comply with the hotel’s fire regulations, in particular to keep escape routes clear, to comply with the smoking ban, etc. Any decoration material brought in by the organizer must also comply with the fire regulations. Attachment of decorative materials and other objects to walls, doors, and ceilings always requires the prior consent of the hotel. The organizer shall be liable to the fire authorities and shall reimburse the hotel for any costs and damages incurred in the event of non-compliance. The organizer is responsible for ensuring that no more people are admitted than the capacity of the room in question. The maximum numbers specified by the hotel are binding. The hotel accepts no liability in the event of non-compliance.
- DOGS
Dogs may only be brought to the hotel with the prior consent of the hotel. Any customer who brings a dog to the hotel is obliged to keep and supervise the animal properly during the stay.
The customer must have appropriate insurance cover (personal liability or pet owner’s insurance) for the dog. By concluding a contract with the hotel based on these GTC, the customer confirms that they have appropriate insurance cover. Proof of this insurance must be presented upon request by the hotel.
- SPA TREATMENTS
Spa treatments can be canceled free of charge up to 24 hours prior to the appointment. Cancelations with less than 24 hours’ notice will incur 80% of the costs. In the event of a no-show, 100% of the treatment costs will be charged.
- RESTAURANT RESERVATIONS
Restaurant reservations can be canceled free of charge up to 24 hours prior to the reservation time. Cancelations made less than 24 hours prior to the reservation time will incur a fee of CHF 80 per person.
- “E-GUMA” VOUCHERS
The respective terms and conditions of purchase apply to vouchers purchased online.
- LIABILITY
The Maistra Rooms and Maistra Lodges are to be used by guests with the utmost care. The guest is liable to the hotel for any damage and loss or other damage caused by himself, his family members, his employees, his representatives, the event participants or other third parties associated with the guest.
The hotel shall not be liable to the guest for slight and medium negligence to the extent permitted by law and shall only be liable for damage caused intentionally or by gross negligence. Should disruptions or defects in the hotel’s services occur, the hotel shall endeavor to remedy such, upon immediate notification by the guest. If the guest fails to notify the hotel of a defect in good time, there is no entitlement to a reduction in the contractually agreed remuneration. The hotel is liable for property brought in by guests in accordance with the statutory provisions; i.e., up to the amount of CHF 1,000. Items that the guest keeps in his hotel room and the safe provided for this purpose are deemed to have been brought in. The hotel is not liable for slight or medium negligence. If valuables (jewelry, etc.), cash, or securities are not handed over to the hotel for safekeeping, the hotel’s liability is excluded to the extent permitted by law. The hotel recommends that money and valuables are always kept in the safe at reception. The guest’s claims are forfeited if any loss or damage is not reported to the hotel as soon as it is discovered.
The hotel is not liable, under any legal title, for services that it has merely arranged for the guest. The hotel accepts no liability for theft of or damage to material brought in by third parties.
- WITHDRAWAL BY HOTEL MAISTRA 160
The hotel is entitled to withdraw from the contract at any time with good cause. Important reasons constituting good cause are in particular official requirements and prohibitions, safety aspects, and cases of force majeure, as well as other circumstances for which the hotel is not responsible or cannot influence. In such cases, the hotel shall assist in organizing suitable alternative capacities.
The hotel may also withdraw from the contract under the following conditions: a) There is reasonable cause to believe that the party booking is jeopardizing the smooth operation, safety, or reputation of the hotel or its guests. b) The hotel discovers that reservations have been booked under misleading or false statements of material facts, or for a purpose other than that communicated. c) Third parties involved in the organization of the event by the hotel at the request of the organizer are prevented from providing the service in whole or in part. The hotel shall declare its withdrawal as soon as it becomes aware of the reasons justifying this, and shall inform the customer immediately. The customer may not assert claims for damages against the hotel in any of the aforementioned cases.
- SEVERABILITY CLAUSE
Should individual provisions of these GTC be invalid, this shall not affect the validity of the remaining provisions. Where this occurs, the invalid provision shall be replaced by a similar but valid provision.
- JURISDICTION AND APPLICABLE LAW
Swiss law shall apply exclusively to all agreements concluded with Hotel Maistra 160 under these GTC. The place of jurisdiction is Pontresina, the registered office of Plattner und Plattner AG (operating company of Hotel Maistra 160).
